Committee of Parliamentary Inquiry Mullet Bay Reports to Parliament on its Operations 

Philipsburg- Sint Maarten, on March 15, 2021 the Committee Parliamentary Inquiry Mullet Bay submitted a report on the operations of the Committee to Parliament thus far, in accordance with article 88 of the Rules of Order for Parliament.

Article 2 of the National Ordinance Parliamentary Inquiry stipulates that the Parliament, on the initiative of one or more Members, can decide to hold a Parliamentary inquiry. This Parliamentary inquiry is then executed by a Committee of Parliament.

In its Public meeting of November 5, 2019 Parliament approved the proposal received on August 13, 2019 by Members of Parliament Rolando Brison, Frans G. Richardson, Christophe T. Emmanuel, Silveria E. Jacobs, Egbert J. Doran, Ardwell M.R. Irion and William V. Marlin to conduct a Parliamentary inquiry into Mullet Bay. A Committee Parliamentary Inquiry Mullet Bay was established on December 12, 2019.

This is the first time in the young history of Country Sint Maarten, that a parliamentary inquiry has been initiated. 

In accordance with article 88, paragraph 1, of the Rules of Order for the Parliament of Sint Maarten, in a letter dated March 15, 2021, the Committee Parliamentary Inquiry Mullet bay updated Parliament on the proceedings of the Committee thus far. 

In its reportthe committeeinformed Parliament of the preparatory work that was needed to allow the Committee to function adequately. This includes the appointment of a Research Coordinator who, together with the Secretary General of the Committee, will guide the research process.

The Committee also held its first official meeting during which a working method was established in accordance with the National Ordinance Parliamentary Inquiry and the proposal for the inquiry.

In its report, the Committee also notified Parliament, that considering the current financial situation of Country Sint Maarten, the Committee has decided to scale back on the number of staff needed for the Parliamentary Inquiry.

Focusing on the on-going construction of the 21-storey (tallest!) Fourteen Mullet Bay Towers in Cupecoy; luxury condos with ocean views everywhere. Key feature being: you will find it difficult hiding from the ocean!!

I live in the area, and drive-by multiple times a day, I can assure you this is a professional operation! Well managed and never any problems! Which is surprising to say for any construction site in Sint Maarten. So this is a great compliment to the background planning and on-going management.

They have also currently started excavation on the foundation for Tower B. Moving quite fast, to be honest, and meeting projections! Even though the Tower names are a little ‘cheesy’ with names like A and B; the completed residences are going to be a class above the rest.

And one of the marvels of this construction project is that when complete, Fourteen at Mullet Bay will be the tallest building in Sint Maarten.
The views from higher floors are going to be ‘mad!”. I can’t wait for the parties!!!

One of the things I wonder most is what are the views like from the Fourteen Towers penthouse? I mean its 360 degree literally! Raw unobstructed Caribbean views, above every hill and mountain in St Maarten. Maybe you can see more islands!?

COVID-19 St Maarten
Since June 2020, St Maarten is open to international tourism, allowing tourism to slowly return to the island, albeit under strict health and safety measures. St Maarten has different entry requirements depending if travellers arrive from countries considered Low Risk or High Risk of transmission.

Thankfully, most businesses, including shops, markets, restaurants, bars, and casinos, have reopened. Beaches are accessible, and water activities are once again allowed. And while boat rental and charters services have resumed, most ferry services to/from neighbouring islands have yet to restart.

Travel entry requirements:

As of January 27 2021 until further notice, a travel ban is in place for persons who have been the 14 days before departing to Sint Maarten in a “banned countries”. Sint Maarten/Sint Martin/Saba/St. Eustatius residents are exempted from the travel ban and should get a rt-PCR test before departure.

The EHAS application must be completed.
Anyone wishing to visit St Maarten, or transit through it to a neighbouring island, must first submit a mandatory health authorisation application via an Electronic Health Authorisation System (EHAS). Click here to apply via the official website: www.stmaartenehas.com.

Processing time can take up to 12 hours.The application must be completed in order to be processed. This includes the purchase of the mandatory COVID-19 insurance, information on the vaccination status (including proof of completed vaccination in case fully vaccinated), a negative COVID-19 test result in case they are required.

If health authorization is pre-approved, you will receive a (printable) pre-authorization PDF via e-mail, which must be presented at check in and to the health and immigration authorities upon arrival.

This PDF will also contain a QR code which will show the vaccination status and COVID test result when scanned. Keep the original rt-PCR or antigen test result and proof of vaccination always with you.

As Saba has their own EHAS operational, as of May 24 same day transit travelers to Saba no longer need to apply in the Sint Maarten EHAS system, but only the Saba EHAS system which can be found here. Proof of the Saba EHAS approval must be demonstrated when transiting through Princess Juliana Airport Sint Maarten.

If health authorization is pre-approved, you will receive a (printable) pre-authorization via e-mail, which must be presented to the health and immigration authorities upon arrival. The original rt-PCR or Antigen test result should be presented to the health authorities upon request.

2 weeks after their second dose in a 2-dose series, such as the Pfizer or Moderna vaccines.

2 weeks after a single-dose vaccine, such as Johnson & Johnson’s Janssen vaccine.

The approved vaccines are: Comirnaty (Pfizer), Moderna, Vaxzevria (Astrazeneca) and Johnson & Johnson/Janssen Resident from Sint Maarten, St Martin, Saba and St Eustatius who are fully vaccinated for two weeks or more, can enter Sint Maarten without testing when originationg from a high risk country.

However, when origination from a banned country, a PCR test within 72 hours before departure must be performed. A rt-PCR test for the SARS-COV-2 virus obtained from a naso-pharyngeal swab performed in the country of origine within 72 hours prior to departure to Sint Maarten (last leg in case of connecting flights) is required for all travelers originating from a country that is categorized as high risk.

Alternatively, travelers originating from the USA and Canada can do an Antigen test for the SARS-COV-2 virus obtained from a naso-pharyngeal swab performed within 48 hours prior to departure to Sint Maarten. All FDA approved antigen tests including those with Emergency Use Authorization only (EUA) are accepted. Travelers residing in and traveling from a low-risk country are exempted from the mandatory rt-PCR or antigen test.

Children of age 10 and under are exempted from the mandatory rt-PCR or antigen test. As of the day after the 10th birthday, a rt-PCR or antigen test has to be submitted. Travelers who reside in a low-risk country but have visited a high-risk country in the 14 days prior to departing to Sint Maarten, must also have a rt-PCR or antigen test for the SARS-COV-2 virus performed within 72 respectively 48 hours prior to departure to Sint Maarten (last leg in case of connecting flights).

The government of Sint Maarten has implemented a mandatory COVID-19 insurance for all travelers with destination Sint Maarten with the exception of Sint Maarten residents, transit passengers, flight crews, transiting cruise ship crews, French nationals residing in France or a French territory, BES-ZVK medical referrals and AUC faculty and students. The insurance purchasing process is an integrated step in the EHAS application. Check the St Maarten proctection plan website for more details.

All incoming passengers are subjected to temperature checks and other screening protocols and may be subjected to mandatory testing at their own expense. If re-tested upon arrival you will be required to self-isolate or self-quarantine at your place of lodging/residence until the test results are known. For travelers originating from a high-risk country, 5 consecutive days of self-monitoring of body temperature and possible flu like symptoms is mandatory. The travelers in this category will receive during 5 days an automated daily email alert providing a link for submitting the required information online.

During your stay: All visitors are expected to adhere to the general health & safety measures in effect on both sides of the island:

It is mandatory to wear a face mask in all public places, on public transportation,
in supermarkets and all areas where social distancing is not feasible.

Keep a social distance of 5-6 ft (1.5 – 2 m) at all times, including beach visits.

Always cough or sneeze into a tissue or crook of your elbow.

Frequently wash and/or sanitise your hands, especially before entering a store.

Coronavirus in Anguilla
Since May 25th 2021, the island’s borders are open once again to visitors

All travellers to Anguilla, including returning resident are required to:
Obtain travel authorization by applying online at ivisitanguilla.com
All visitors to Anguilla who are eligible to be vaccinated against COVID-19 are required to be fully vaccinated at least three weeks before arrival. According to Anguilla’s Ministry of Health, fully vaccinated means, visitor has received last dose (in a 2 dose vaccine) only dose (in a 1 dose vaccine) 3 weeks/ 21 days prior to arrival on Anguilla.

The Government of Anguilla’s exemptions to the mandatory visitors’ vaccination requirement for entry permission are: pregnant women and children 17 years and under. But they may be subjected to RT-PCR testing 4 days after arrival.
All travelers will be required to produce a negative COVID-19 test administered 3-5 days prior to arrival.
You will be tested at your Port of Entry.
You will be issued a yellow wristband.

After clearing Immigration and Customs, you will be required to travel immediately via Safe Environment Certified ground transportation to your accommodation/properties.
You are required to remain at your accommodation/properties until in receipt of your Port of Entry negative RT-PCR COVID-19 test result. (Test results are usually received within 12hrs of testing.). Until in receipt of your Port of Entry negative RT-PCR COVID-19 test result, you are to maintain Social Distance of at least 3ft from individual(s) not of same travel group; you are to utilize restaurants on property and food delivery services; and access to spas/ spa services and gyms is prohibited.

Use of rental vehicles before receipt of Port of Entry negative RT-PCR COVID-19 test result, is prohibited.
Once in receipt of your Port of Entry negative RT-PCR COVID-19 test result, you can leave your accommodation and explore the island at will.

All visitors are required to provide proof of insurance which covers COVID-19 medical costs and full hospitalization, doctors’ visits, prescriptions and air ambulance. (Please note that this does not apply to residents of Anguilla).

After a successful vaccination campaign, 85% of the adult population on the island has been fully vaccinated against COVID-19. Saba has partially reopen its borders. Feel free to check the official travel advisory.

The entry requirements include:
Travelers who are fully vaccinated will not have to follow any quarantine measures. Do ensure that you have your vaccination card readily available to present to Immigration and Public Health.

Non-vaccinated travelers from high-risk and very high-risk areas who wish to visit the island, will have to quarantine in place for 5 days. A Rapid Antigen test will be administered on day 5.
Non-vaccinated persons under the age of 18 traveling to Saba from high-risk areas will not have to go into strict quarantine as they are much less infectious, but will have to stay out of school, daycare, afterschool care and social activities for 5 days after arrival. Non-vaccinated persons under the age of 18 traveling to Saba from verry high-risk areas will have to quarantine for 5 days.

Day trips are only available for fully vaccinated travelers.
All travelers must obtain approval before arrival through an automated Saba EHAS entry application. Travelers applying via the EHAS will receive an immediate automatic response, followed by an approval letter, with the necessary stipulations for entry to the island, within 24 hours.
Corona test requirements:
If you are fully vaccinated:

Persons traveling from a low-risk will not require a pre-travel test, except, travelers who reside in or have visited a low-risk country for 5 or more days, but have visited a high-risk country in the 14 days prior to departing to Saba, must also have a rt-PCR or antigen test for the SARS-COV-2 virus performed in the country of origin within 72 hours prior to arrival in Saba ( or last leg in case of connecting flights).

Persons traveling from a high-risk country must show proof of a negative PCR or Antigen test result (test must be taken within 72 hours before arrival in Saba).

Fully vaccinated residents and non-residents traveling from a very high-risk country must show proof of a negative rt-PCR test result and quarantine in place for 5 days. A rt-PCR test will be administered on day 5.

Vaccinated residents leaving the island for a maximum of 2 nights are not required to take a pre-travel test before returning to Saba.

Day Trippers who are fully vaccinated and their children can also visit the island with proof of a negative PCR or Antigen test result. Pre-travel test can be max. 72-hours old before arrival to Saba. Day Trippers must be able to present their vaccination card and approved travel exemption letter to the check-in counter of the airline or ferry, prior to travel to Saba, and again upon arrival on the island.

If you are non-vaccinated:

  • If you are traveling from a high-risk or very high-risk country, you must show proof of a negative PCR or Antigen test result (test must be taken within 72 hours before arrival in Saba). A Rapid Antigen test will be administered on day 5.
  • Persons traveling from low-risk countries do not require a pre-travel test.

If you are non-vaccinated, and under 18 years old:

  • Upon arrival, a Rapid Antigen test (nasal) will be administered for children 2-10 years old. On day 5, a Rapid Antigen test (nasal) will also be taken for all non-vaccinated persons under the age of 18.
  • Children over 10 traveling to Saba from a high-risk country must show proof of a negative pre-travel PCR or Antigen test result, no more than 72-hours prior to travel to Saba
  • Children over 10 traveling to Saba from a very high-risk Country must show proof of a negative pre-travel PCR test result, no more than 72-hours prior to travel to Saba. Upon arrival, a rt-PCR test (nasal) will be administered for children 2-10 years old. On day 5, a rt-PCR test (nasal) will also be taken for all non-vaccinated persons under the age of 18.
    Travelers need a travel insurance that provides coverage for COVID-19, hospitals, and any medivac circumstances that may occur.
    Masks are required during travel to Saba and inside the terminal and port buildings.
    Non-vaccinated travelers must ensure that a taxi pick-up from the airport is confirmed prior to arrival. Check the taxi list here.
    Risk categorization:

Low-risk countries: Countries/ territories are considered low risk if there is no active local circulation of SARS-COV-2 over the past 14 days. These include St. Eustatius, St. Kitts and Nevis and Montserrat.
Very high-risk countries: Very High Rick Countries are designated by the Dutch Ministry of Health, based on widespread circulation of some Variants of Concern. Here is a link to the most updated list of these countries. The Netherlands is categorized as a Very High-Risk country for entry to Saba.
High-risk countries: All other countries are considered high risk including St. Maarten, Curaçao, Aruba, Bonaire, United States of America, Canada, Anguilla and St. Vincent and the Grenadines.

What can we do to help the locals?
St Martin’s tourism industry has almost entirely collapsed. St Martin/St Maarten and its surrounding islands are suffering from a severe economic downturn, putting many people out of work and under incredible strain, given that tourism drives the region’s economy.

A way to help the locals is to consider rescheduling your travel plans instead of cancelling bookings entirely.

You could also decide to book your next vacation now, even if this means booking more than a year in advance.

The time away has been a bitter moment for all of us, but The Friendly Island is proud to announce that we are welcoming back our international visitors to our beautiful shores. We kindly ask our visitors to read our safety protocol and travel requirements below before traveling to St. Maarten. See you soon!

TRAVEL ENTRY REQUIREMENTS

To ensure the safety and well-being of visitors and residents, entry requirements will be in place for visitors to enter St. Maarten along with other safety measures at the Princess Juliana International Airport.GENERAL INFORMATION

ST KITTS AND NEVIS ELEVATED TO HIGH RISK EFFECTIVE JUNE 17 TILL FURTHER NOTICE.

EHAS TO ISSUE A QR CODE WITH THE HEALTH AUTHORIZATION PRE-APPROVAL AS OF JUNE 9. TRAVELERS ARRIVING WITH AN EARLIER ISSUED PRE-APPROVAL WILL BE ADMITTED.

AS OF JUNE 15 ALL FULLY VACCINATED RESIDENTS FROM SINT MAARTEN AND THE BES ISLANDS CAN ENTER SINT MAARTEN WITHOUT TESTING, HOWEVER, WHEN ORIGINATING FROM A BANNED COUNTRY A rt-PCR TEST WITHIN 48 HOURS BEFORE DEPARTURE MUST BE PERFORMED ADDITIONALLY.

AS OF JULY 1 THE rt-PCR TEST MUST BE PERFORMED ON A NASO-PHARYGEAL SWAB WITHIN 72 HOURS BEFORE DEPARTURE BY TRAVELERS ORIGINATING FROM THE USA AND CANADA. ALTERNATIVELY THESE TRAVELERS CAN ALSO PERFOM AN ANTIGEN TEST WITHIN 48 HOURS PRIOR TO DEPARTURE TO SINT MAARTEN.

1. Due to the COVID-19 epidemic Sint Maarten has established a mandatory health pre-authorization application through an Electronic Health Authorization System (EHAS) for every visitor arriving by air including transits, Sint Maarten and Sint Martin residents. Without the health pre-authorization boarding will not be possible. Be advised that processing time can take up to 12 hours. Visitors arriving on a maritime vessel please read the latest requirements here.

2. As Saba has their own EHAS operational, same day transit travelers to Saba no longer need to apply in the Sint Maarten EHAS system, but only the Saba EHAS system which can be found at http://www.sabatourism.com/travel-requirements. Proof of the Saba EHAS approval must be demonstrated when transiting through Princess Juliana Airport Sint Maarten.

3.The requirements vary depending on the country risk status which can be found at the bottom of this page.

4.People are considered fully vaccinated:
– 2 weeks after their second dose in a 2-dose series, such as the Pfizer or Moderna vaccines, or
– 2 weeks after a single-dose vaccine, such as Johnson & Johnson’s Janssen vaccine

5.The application must be completed in order to be processed. This includes proof of a negative COVID-19 test result, information on the vaccination status (including proof of completed vaccination in case fully vaccinated) and the purchase of the mandatory COVID-19 insurance in case required. Children must have the online health form filled out by their parents. Provide a working email address on which you are reachable.

6. Do not travel if you are suffering from flu like symptoms and/or have a fever.

7. As of January 27, 2021, until further notice, a travel ban is in place for persons who have been the 14 days before departing to Sint Maarten in a banned country as mentioned in the “banned countries” table below.

8. Sint Maarten/Sint Martin/Saba/St. Eustatius residents are exempted from the travel ban and should get a rt-PCR test before departure (see below). The EHAS application must be completed.

9. All incoming passengers are subjected to temperature checks and other screening protocols and may be subjected to mandatory testing at their own expense. Failure to comply with the screening at the Health Check Point upon arrival will result in you not being cleared to enter St. Maarten and sent back to your originating country.

10. If re-tested upon arrival you will be required to self-isolate or self-quarantine at your place of lodging/residence until the test results are known.

11. Applicants will receive confirmation of their accepted application. Non-completed applications will be automatically deleted within a day after the provided travel date.

12. If health authorization is pre-approved, you will receive a (printable) pre-authorization PDF via e-mail, which must be presented at check in and to the health and immigration authorities upon arrival. This PDF will also contain a QR code which will show the vaccination status and COVID test result when scanned. Keep the original rt-PCR or antigen test result and proof of vaccination always with you. Please check your spam/junk mail folder as well in case you haven’t received a response.

13. If health authorization is not pre-approved, you will receive an e-mail informing you that health pre-authorization has been denied.

CRUISE SHIP PASSENGERS ARRIVING BY AIR AND DEPARTING FROM SINT MAARTEN

1. All passengers must complete the application procedure through EHAS before departing to Sint Maarten.

2. Within 48 hours, before disembarking again in Sint Maarten at the end of the cruise, all passengers 10 years of age and older must have an antigen test performed by the cruise line.

3. Applying through EHAS is not necessary when returning to Sint Maarten at the end of the cruise.

4. The purchase of COVID-19 insurance (see below) is mandatory when staying more than one (1) day in Sint Maarten either before or after the cruise. The insurance is only valid during the days of stay in Sint Maarten between the arrival date and return date to the country of origin.

MANDATORY COVID-19 INSURANCE

1. The government of Sint Maarten has implemented a mandatory COVID-19 insurance for all travelers with destination Sint Maarten with the exception of Sint Maarten residents, transit passengers (checkbox), flight crews (checkbox), transiting cruise ship crews (checkbox), French nationals residing in France or a French territory, BES-ZVK insured (checkbox) and AUC faculty and students (special procedure).

2. The insurance purchasing process is an integrated step in the EHAS application. Travelers requiring the COVID-19 insurance must complete this process upon application.

COVID-19 TEST REQUIREMENTS

All travelers, with the exception of Sint Maarten and BES residents, originating from Aruba:

The following applies: For fully vaccinated travelers, a negative Ag test result within 48 hours before departure is required. Official proof of the vaccination status (national vaccination card) must be uploaded in EHAS. The Ag test must carry at least an FDA-EUA approval. For non-fully vaccinated travelers, a negative rt-PCR test result obtained from a naso-pharyngeal swab within 48 hours before departure is required.

Other travelers:

A rt-PCR test for the SARS-COV-2 virus obtained from a naso-pharyngeal swab performed in the country of origin and within 72 hours prior to departure to Sint Maarten (last leg in case of connecting flights) is required for all travelers originating from a country that is categorized as high risk. Antibody tests and tests performed outside of the 72 hours period will not be accepted. Results from home covid-19 collection test kits will also not be accepted. Airlines might require you to show a negative lab test result.

2. Alternatively, travelers originating from the USA and Canada can do an antigen test for the SARS-COV-2 virus obtained from a naso-pharyngeal swab performed within 48 hours prior to departure to Sint Maarten. All FDA approved antigen tests using a nasopharyngeal sample including those with Emergency Use Authorization only (EUA) are accepted. Tests performed outside of the 48 hours period and home tests will not be accepted.

3. Travelers residing in and/or traveling from a low-risk country are exempted from the mandatory rt-PCR or antigen test.

4. Travelers who reside in a low-risk country but have visited a high-risk country in the 14 days prior to departing to Sint Maarten, must also have a rt-PCR test for the SARS-COV-2 virus performed in the country of origin within 72 respectively 48 hours prior to departure to Sint Maarten (last leg in case of connecting flights).

5. The original test result to be uploaded as part of EHAS application procedure must clearly specify the name of the laboratory or clinic, full name of test subject, type of test administered, name of antigen test, swab date, source of the swab, result date and a negative result. Incomplete results, hand written or e-mail statements from doctors will not be accepted.

6. Children of age 10 and under are exempted from the mandatory rt-PCR or antigen test. As of the day after the 10th birthday, a rt-PCR or antigen test has to be submitted.

7. Airline and private flight crews with stopovers in St. Maarten or St. Martin must demonstrate a valid negative rt-PCR or antigen test upon arrival. Crew members not in possession of a valid negative rt-PCR or antigen test must self-quarantine until their departure flight.

SELF MONITORING

1. For travelers originating from a high-risk country, 5 consecutive days of self-monitoring of body temperature and possible flu like symptoms is mandatory. The travelers in this category will receive an automated daily email alert providing a link for submitting the required information online the first 5 days of their stay. If you are remaining for a shorter term on the island, you will have to submit the information for the time you are on the island. Temperature measuring possibilities will also be offered in the lobby in most hotels and other lodging facilities.
