Sint Maarten Airport Requests that Controllers be Prohibited from Carrying Out Strikes

To prevent air traffic controllers from stopping air traffic again, the Company that Operates the Princess Juliana International Airport in Sint Maarten applied to the Court of First Instance in preliminary proceedings to ban the Windward Island Civil Servants Union (WICSU) organize another strike like the one held last Saturday, January 15, the court is expected to rule on this matter on Friday, January 28.

It should be remembered that, as an emergency measure, a judge ordered the union to call its members to resume work from 5:00 p.m. on that Saturday, under penalty of a fine of US$100,000 for each hour that the strike was prolonged.

Richie Kock, a lawyer for the union, said that the strike is legitimate and that it was the last recourse that the controllers had to demand the payment of the Cost of Living Adjustment (COLA) corresponding to the years 2018, 2019 and 2020. Kock also highlighted that the Controllers have strictly adhered to the prohibitions imposed by the judge in the precautionary measure and added that they do not plan to take any further action.

For her part, lawyer Caroline van Hees, representative of the airport operator, said that due to Hurricane Irma and the COVID-19 pandemic they are not able to meet their obligations without external financial support, but stressed that despite this, people have been laid off and the base salary of all employees has always been paid.
