ABOUT PARLIAMENT

The parliament is the highest legislative body of country Sint Maarten and represents the entire population of the Dutch side of the island.  The parliament consists of 15 members who are elected for a four-year period.

The session year of parliament commences on the second Tuesday of September.  During this session, the Governor provides an explanation of the policy to be pursued by the government.
The parliament elects a President and Deputy President from its own numbers.
The President of Parliament shall open and close the session year of the Parliament.

Role and Function of Parliament The two most important tasks of parliament is the realization of legislation for Sint Maarten, and secondly, to exercise control over Government’s policy.  Under the first task, Parliament exercises this task together with Government, so Parliament is called the co-legislator.

​The right to approve and amend the budget;

The right of interpellation where each Member of Parliament (MP) has the right to question ministers of government in the General Assembly of Parliament;

The right of initiative allows MPs to submit draft laws on their own initiative;

The right to amendment, allows MPs to amend legislation that has been submitted to Parliament;

The right to ask questions, every MP can question a Minister orally or in writing;

The right to instigate inquiries allows parliament to institute an inquiry into the state of affairs in an event in which Government is involved.

The Democratic Party (DP) won 17.1% of the vote (2 seats in parliament) and the United People’s Party (UPP) won 36.1% of the vote (6 seats in parliament) and formed a governing coalition.  They beat the National Alliance (NA) which one 45.9% of the vote (7 seats).   • The election preceded the complete dissolution of the Netherlands Antilles which occurred on 10 October 2010. Sint Maarten then became a semi-autonomous entity within the Kingdom of the Netherlands.

ADMISSION MEMBERS OF PARLIAMENT

To be eligible for membership of Parliament, a person must be a resident of Sint Maarten, a Dutch national, must have attained the age of eighteen years and his/her right to vote must not have been taken away.

After the results of the election are established by the Central Voting Bureau, the elected Member presents his/her credentials to Parliament. The credentials consist of the following:

  • Notification by the Chairman of the Central Voting Bureau to the elected Member of his/her election;
  • Proof of notice from the Chairman of the Central Voting Bureau that the elected Member accepts his/her election.

Besides the credentials, the elected Member also has to submit the following documents to Parliament:

Declaration stating whether or not the elected Member has a public function;

Declaration indicating that the elected Member has not acted in contravention with the National ordinance registration and finances of political parties during the election campaign;

For those elected Members who have not been a Member of Parliament before, also an extract from the Civil Registry.

During the investigation of the credentials, it is ascertained whether the elected Member has any functions which are incompatible with the membership of Parliament, such as:

  • Member of the Council of Advice
  • Member of the General Audit Chamber
  • Ombudsman

  • Minister Plenipotentiary
  • Active civil servant
  • Member of the Judicial branch
  • Solicitor General or Attorney General at the Common Court of Justice of Aruba, Curaçao and Sint Maarten and Bonaire, Saba and Sint Eustatius

Close family relations between the Members of Parliament may also be an impediment to being admitted as a Member of Parliament.
